Terms and Conditions

1.1 Gigabyte Technologies t/a Career Corner (hereinafter referred to as "Career Corner"), is a privately owned close corporation of South Africa.

1.2 The Recruiter and/or Employer (hereinafter referred to as “Agent”) agree to an online, paperless subscription and acknowledges that all the information that is submitted online is true and correct and to the best of their knowledge. The Agent agrees that the act of submitting the order form online is in lieu of their signature and that invoices will follow after order processing.

1.3 This agreement applies to all accounts and sub-accounts. A Career Corner account may not be transferred or ceded without prior written approval from Career Corner.

1.4 Job Seekers get a free of charge CV on the website (excluding Priority CV listings) which is used to search and apply for employment.

1.5 Curriculum Vitae (CV) Design Services and Priority CV Listing products and services attract a transaction fee that is payable at the execution of the transaction.

1.6 Career Corner offers a free of charge 3 job listing package to Agents on a trial basis. This is only available once to an Agent. This package can be removed at any time but the existing subscribers will remain on the package until it lapses.

1.7 Career Corner offers a subscription based-fee for advertisements for employment, banners, buttons and other services on the website, www.careercorner.co.za.

1.8 Access to the Job Seekers’ CV is only made available to approved Agents which have been provided with an username and password to access the Career Corner database.

1.9 Career Corner makes every effort to ensure that the job seekers’ and/or Agents’ data is treated in the strictest confidence, however, Career Corner will not be held responsible if a CV and/or advertisement for employment was unlawfully copied from the Career Corner website and/or distributed without your consent.

1.10 Agents may access the Career Corner database for CVs solely for the purpose of identifying Job Seekers that match their clients’ vacancy advertisements with Career Corner.

1.11 Career Corner shall not divulge any personal information obtained from Agents to any third parties unless:

1.12 Career Corner shall display Agent logos’, names and contact details on the website.

1.13 The Job Seeker and Agent are responsible for implementing sufficient protective software on their system as Career Corner can not ensure or guarantee that its website and all files available for downloading (and delivered through electronic mail to Agents’ e-mailboxes) are free from viruses, worms etc.

1.14 The Job Seeker and Agent agree to take precautionary measures to ensure that their CV on Career Corner is free from viruses or any other destructive code.

1.15 The Job Seeker agrees to be truthful, to the best of their knowledge, in their CV presented on Career Corner.

1.16 Career Corner reserves the right to either reject and/or remove any CV and/or advertisement for employment from its website for any reason whatsoever. These advertisements, comments, banners or graphics will not be allowed and will result in immediately removal thereof with no refund.

1.17 Career Corner makes every effort to publish advertisements and deliver applications for employment to the Agent and can not be hold liable for any loss/damage as a result of any failure and/or delay in the delivery of an application for employment and/or failure and/or delay in listing an advertisement.

1.18 Career Corner provides an online platform for Agents to place employment advertisements and engage with Job Seekers on the Career Corner website. All advertisements are uniquely referenced, linked to a category and job title selected by the Agent.

1.19 Agents is liable for compliance with the South African laws (Labour Law, Basic Conditions of Employment etc);

1.20 All advertisements placed on the website will remain visible for the period specified in the subscription selected by the Agent;

1.21 Career Corner shall endeavour to keep advertisements for employment available at all times, however, the Agents agrees that Career Corner shall not be liable to Agents or any other person whatsoever in respect of any loss or damages caused by or arising from the unavailability or any interruption in the display of the advertisements for employment for any reason whatsoever.

1.22 Career Corner shall endeavours to notify Agents via electronic mailing of any maintenance and repairs which may result in the advertisements of employment being unavailable, but do not warrant that such notice will be given in advance.

1.24 Career Corner accepts no responsibility or liability for any errors or omissions for any advertisements for employment. Agents are required to check their advertisements for errors before they are published on the website.

1.25 Career Corner may temporarily deny service or terminate this agreement upon the failure of Job Seeker or Agent to pay charges when they become due. In the event of 30 days of non-payment of the account, you agree that Career Corner has the right to deactivate the account.

1.26 If an account was deactivated due to non-payment, a fee of R49 will be charged for the re-activation of the account. Should the account not be paid in full by the due date for 3 months', Career Corner reserves the right to cancel the Agent and/or Job Seekers' account. In the event that the Agent and/or Job Seekers' account is still in arrears after 3 months' Career Corner reserves the right to hand the account over for collection. Any and all collection and legal costs will be for the account of the Agent or Job Seeker.

1.27 In order to cancel the subscription (whether used or unused), this can be done at any time from the “My Accounts” section in the website after logged on as a Job Seeker or an Agent. Once the profile has been cancelled, no advertisements for employment or any other services will be allowed. Any unused items will not be refundable.

1.28 All prices on the website are valid from 1 January 2016 and include VAT and may be changed without notice.

1.29 All invoices are payable in full (without deduction or set off for any errors or omissions in advertisements) on or before month end of the date of invoice. Interest is chargeable for late payments in accordance with the prevailing ABSA prime overdraft rate.

1.30 Invoices must be paid into the Career Corners’ bank account:

1.31 Career Corner reserves the right at its sole discretion to refuse or cancel a service. Violation of any of Career Corners’ terms and conditions could result in a warning, suspension, or possible account termination.

1.32 The Job Seeker hereby indemnify Career Corner and its Agents against all claims, actions, suits, liabilities, costs and expenses incurred as a result of the CV listing on the website.

1.33 Agents agrees to keep Career Corner and its associates fully indemnified against any actual or contingent liabilities incurred in relation to any actions or claims brought by any person against Career Corner as a result of an actual or alleged breach by him/her of any law, or such other actions or claims brought.

1.34 The Job Seeker and/or Agent hereby acknowledges that the network may, at various time intervals, be down due, but not restricted to, utility interruption, equipment failure, natural disaster, acts of God, or human error. In no event shall Career Corner be liable to the Job Seeker and/or Agent for any damages resulting from or related to any failure or delay in providing access to the internet under this agreement. In no event shall Career Corner be liable to the Job Seeker and/or Agent for any indirect, special or consequential damages or lost profits arising out of or related to this Agreement or the performance or breach thereof. The terms of this section will survive any termination of this agreement.

1.35 Career Corner retains all intellectual property rights in the data stored and services provided on Career Corners’ website and all information, layout and content is copyright protected.

1.36 This agreement constitutes the whole agreement between the parties relating to the subject matter hereof. No amendment or consensual cancellation of this agreement or any provision or term thereof shall be binding unless recorded in a written document signed by both parties.
